Terms of Service

These Terms of Service ("Terms") govern your participation in the Surf Caddy beta programme operated by Surf Caddy ("we", "us", or "our"). By registering for or using the beta, you agree to these Terms. If you do not agree, please do not participate.

The Surf Caddy beta is a pre-release testing programme. The app and service are provided in an unfinished state for the purpose of gathering feedback and improving the product before public launch.

As a beta participant you acknowledge that the app may contain bugs, errors, or incomplete features; features may change, be removed, or behave unexpectedly; service availability is not guaranteed; and your data may be lost or reset during the beta period.

As a beta participant you agree to provide accurate information when registering, use the app only for its intended purpose, not attempt to reverse-engineer or distribute any part of the app, provide honest feedback when requested, and keep any non-public information about the beta confidential.

Surf Caddy provides guidance to help you make better decisions about when and where to surf. It does not replace your own judgement, experience, or responsibility for your safety in the water.

Always assess conditions yourself before entering the water. Never surf beyond your ability. Surf Caddy accepts no liability for decisions made based on its recommendations.

All content, design, code, and materials in the Surf Caddy app and website are owned by or licensed to Surf Caddy. You may not reproduce, distribute, or create derivative works without our written permission.

Feedback you provide during the beta may be used by us to improve the product without any obligation to compensate you.

To the maximum extent permitted by law, Surf Caddy is not liable for any loss or damage arising from your use of or inability to use the beta, including any decisions made based on surf guidance provided by the app.

The beta is provided "as is" without warranties of any kind, express or implied.

We may suspend or terminate your access to the beta at any time, for any reason, without notice. You may withdraw from the beta at any time by contacting us.

We may update these Terms from time to time. We will notify beta participants of material changes by email. Continued participation after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
